Corsair Force 3 120gb not reaching advertised speeds

I just received my 1124 serial number force 3 128GB, I took the chance with Corsair knowing there was a problem with the older batch. Anyway, so far the drive is working properly, didn't BSOD or freeze yet. It's been running for several hours. However I am just not reaching the 550MB speed as advertised.

 

I am using the Intel SATA3 port on my ASrock P67 Extreme4 mobo. I have done some research and it is recommended to use the Intel SATA3 port than the Marvell. As the screen shot shows my drive speed maxes out at 400MBish, I haven't done any drive erase or anything, just using it out of the box. I haven't updated my mobo bios yet, I just don't want to brick anything because everything is running fine as it is.

 

Also YellowBeard, I don't know what's wrong with my CPU speed reading, several software are showing different speeds. ALso, CPU-Z just shows my speed going from 1500mhz to 4400mhz. When CPU is being used, the speed goes to OCed 4.4ghz, when it's not being used, it goes down to 1.5Ghz. It's supposed to stay at OCed speed, not going back and forth. How do I fix this?

thats speedstep c1e or eist at work. personally i turn it off to run full speed all the time, i dont like my motherboard making decisions for me.
